Terms of Service

These terms govern your agency's use of AgentFlex, a software service for creating property proposals, marketing websites and social content. By subscribing, or by using the service on a free trial, you agree to them on behalf of the agency you represent.

1. The licence

We grant your agency a non-exclusive, non-transferable right to use AgentFlex for its own real estate business. You may not resell, sublicense, white-label or provide the service to another agency, and you may not copy or reverse engineer it. Each agent seat is for one named person.

2. Accounts and seats

Your agency administrator is responsible for the users they invite, for the accuracy of information entered, and for keeping login credentials secure. Seat limits are set by your plan; additional seats are charged at the rates shown at checkout.

3. Fees, renewals and cancellation

• Fees are payable in advance, monthly or annually as selected, and are quoted in NZD.
• Subscriptions renew automatically until cancelled. Either party may cancel with effect from the end of the current paid period.
• Setup fees are one-off and non-refundable once configuration has begun.
• If payment fails, we may suspend access after reasonable notice until the amount is paid.
• Fees may change with at least 30 days' notice before your next renewal.

4. Your content

Your agency owns the property information, client details, photos, branding and documents it uploads. You are responsible for having the right to use that material, including photographs and vendor contact details. We hold it only to run the service for you.

5. Our content

AgentFlex, its templates, layouts and software remain our property. Documents and websites you produce with it belong to your agency.

6. Availability and changes

We aim to keep the service available continuously but do not guarantee uninterrupted access. We may change or improve features, and will give reasonable notice of changes that materially reduce what your plan provides.

7. Acceptable use

You must not use AgentFlex to break the law, to send unsolicited bulk email, to publish misleading property information, or to interfere with the service or other customers' use of it.

8. Liability

To the extent permitted by law, our liability for any claim relating to the service is limited to the fees your agency paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost listings or lost commission. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.

9. Termination

We may terminate this agreement if fees remain unpaid after notice, or if these terms are seriously breached. On termination your access ends; we will make your data available for export for 30 days on request, then delete it.

10. Governing law

These terms are governed by New Zealand law.
